The federal appeals court has upheld a ban on sending national guard in Portland, Oregon, following a recent court ruling.

Appeals Court Agrees to Rehear Legal Matter

The federal appeals court ruled on this week that it would reexamine the case concerning the executive power with an larger panel of eleven justices. The court also vacated a previous decision from a three-judge panel that had sided with the administration.

Ongoing Dispute Over Troop Deployment

This order represents the most recent development in a protracted legal battle over whether the administration has the authority and valid reason to send state military units in Portland. Approximately two hundred troops have been in limbo since the end of September when the mobilization attempt was started in due to months of protests.

Conflicting Arguments

The federal government has claimed that federal officials at the ICE facility in the southern part of the city were facing threats, while city and state officials assert that local officers have control of the situation.

In defiance of descriptions of the city as “war ravaged”, residents have been posting footage of lush hiking trails and a vibrant culinary culture, and planning events such as an Emergency Naked Bike Ride against the “militarization of our city”.

Recent Legal Actions

The Tuesday ruling came after a federal judge in Portland enacted two legal injunctions this period – one preventing the federal control of the state troops, and another prohibiting the use of any national guard troops in the state, after efforts to circumvent the initial injunction by calling up out-of-state forces.

On Monday, the appeals court had temporarily suspended the initial decision – permitting control of 200 Oregon national guard – but the second ruling stayed effective, blocking the actual deployment of the forces.

Full Panel Consideration

The latest ruling means the matter will be heard “en banc” – with all decisions under review simultaneously – by a group of 11 judges.

“This decision shows that facts are important and that the judicial system are striving to hold this administration accountable. The constitution limits the president’s power, and Oregon’s communities cannot be treated as a training ground for unchecked federal authority,” stated the legal representative in a official comment.

“The judicial body is sending a definite signal: the executive leader cannot dispatch the armed forces into US cities without cause. We will continue defending state legislation, principles, and sovereignty as this case progresses and our legal battle continues in the judicial system.”
